Legal & Responsible Use Policy

Every product supplied by Pep Pens Pty Ltd (reusable pens, disposable pens, cartridges, needles, cases and related accessories) is a self-injection delivery device intended for use by registered Australian health professionals within their scope of practice.

Pep Pens products are:

• Delivery devices and consumables, not medicines
• Supplied to registered Australian health professionals, not to the general public
• Not a substitute for clinical assessment, prescribing or professional judgement
• Not intended to be sold, re-supplied or used outside the conditions described in this policy

Any prescription medicine administered with a Pep Pens device is prescribed, dispensed and supplied separately by the treating practitioner and pharmacy, under the relevant Australian medicines and poisons laws. Pep Pens does not prescribe, dispense or supply prescription medicines, and nothing on this site is an offer to do so.

Pep Pens devices are delivery instruments. They are not represented as treating, curing or preventing any condition, and no therapeutic outcome is claimed for the device itself. Responsibility for the lawful prescription, clinical appropriateness and safe administration of any medicine used with a device rests entirely with the treating health professional.

We do not advertise specific prescription medicines to the public, in accordance with Australian regulatory requirements. Information on this site is provided to support registered health professionals in selecting and using the device, and is general in nature only.

Reusable pens and their components are precision devices supplied non-sterile. They must be cleaned, handled and stored in line with the instructions for use and your own infection-control standards before and between uses.

Single-use consumables such as needles and cartridges are supplied in factory-sealed packaging by the original manufacturer. Pep Pens:

• Does not independently test the sterility of supplied consumables
• Does not open, re-package or re-sterilise sealed consumables
• Cannot guarantee that sterility is maintained once items leave our control or after onward handling, storage or transport by the recipient

Inspect all packaging on receipt and before each use. Do not use any item where the packaging or seal is damaged, opened or otherwise compromised. Set it aside and dispose of it appropriately.

By purchasing or using any Pep Pens product, you confirm that you are a registered Australian health professional acting within your professional capacity, and you agree to:

• Use products only within your lawful authority and scope of practice
• Follow the instructions for use and all applicable storage, handling, hygiene and infection-control standards
• Comply with all relevant professional obligations and Commonwealth, state and territory laws governing medicines, devices and clinical practice
• Dispose of needles and single-use consumables as clinical and sharps waste in line with applicable requirements
• Accept responsibility for safe administration and for the safety of any person to whom a device is applied

Pep Pens is not responsible for misuse, use outside your professional scope, unsafe handling, improper storage, or any use of a product that is contrary to its instructions for use or this policy.

Pep Pens makes no representation about the clinical suitability of any device for a particular patient, medicine or indication. Those decisions are matters for the treating practitioner's professional judgement.

Our products come with the express warranties described in the relevant product information. Beyond those, and to the extent permitted by law, we give no further warranties about the device's suitability for any specific clinical purpose.

Nothing in this policy excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or other rights that cannot lawfully be excluded.

By completing a purchase from Pep Pens, you confirm that you:

• Are a registered Australian health professional purchasing in your professional capacity
• Understand that Pep Pens products are delivery devices and consumables, not medicines, and that any medicine used with a device is prescribed and supplied separately
• Understand that single-use consumables are supplied factory-sealed but that sterility cannot be guaranteed after delivery or onward handling
• Accept responsibility for the lawful, safe and appropriate handling, storage, use and disposal of all products
